This Privacy Policy (the "Privacy Policy") sets out the term on which Accelbyte, Inc. ("AccelByte", "we", "our", "us") processes personal information on our website, as available at https://accelbyte.io/, as well as such other websites, platforms, and services as we may make available from time to time which link to or otherwise incorporate this Privacy Policy by reference (collectively the "Site").

Please read this Privacy Policy carefully before using our Site. By using or otherwise accessing any of our Site, you agree that you will comply with this Privacy Policy, together with our Terms of Use (available at https://accelbyte.io/terms-of-use) and all other applicable terms and policies linked or referenced within the Terms of Use or this Privacy Policy.

Definition of Personal Information

Information that we collect from you through the Site falls into two categories: 

  • "personal information", which means information that can be used to identify you under applicable data privacy laws. The term "personal information" can include information such as your name, address, telephone number, and e-mail address, but can also include indirect identifiers such as your IP address or device identifier.
  • "non-personal information", which means data that is collected in relation to your use of the Site, but which does not identify you and is not directly linked to your personal information. Such non-personal information is not subject to the terms of this Privacy Policy.

Personal and non-personal information are both referenced throughout this Privacy Policy as "information about you".

Changes to This Policy

We may revise and update this Privacy Policy at any time. We will notify you of significant changes to this Privacy Policy by placing a prominent notice on our Site, posting any amendments to this page, and/or using such other means as we deem appropriate. The "Last Updated" date provided at the top of this page when we post the updated version of this Privacy Policy. If you have registered for an account to use our Site, we may also notify you of changes to this Privacy Policy by sending a notice to the primary e-mail address specified in your account.

We encourage you to review our Privacy Policy whenever you visit the Site to make sure that you understand how your personal information is being treated. If you use our Site after the Privacy Policy is amended, your use will represent your agreement to the amended terms of this Privacy Policy. If at any time you determine that you are no longer able to agree to this Privacy Policy, then you may not use our Site.

Data That We Collect

Depending on the technology that you use to access or use our Site, and how you interact with us or use or interact with our Site, we may collect information about you directly, automatically, and through third parties when you use or otherwise access the Site. The types of information that you may provide in each category, along with the technologies that we use to collect such information, are generally described in the sub-sections below. Our purposes for using or otherwise processing personal information are described in the section titled "Our Uses of Personal Information".

User Data

"User Data" is the personal information that you provide to us directly when you sign up to receive informational e-mails from us, send us e-mail messages, or otherwise use our Site. Any User Data that we receive about you is provided directly by you, or on your behalf, on a voluntary basis. We describe the most common types of User Data that you may expect to provide below:

  • Account Registration. If you register for an account on our Site, you may be required to provide us with personal information such as your name, the game studio with which you’re associated, and your e-mail address. You may also provide other personal information at your election as part of the account setup process.
  • Communications with Accelbyte. When you send e-mail messages to Accelbyte, we may receive personal information about you, and may use the information provided by you to respond to your communication and/or as described in this Privacy Policy. We may also archive this information and/or use it for future communications with you where we are permitted by law to do so.

Any personal information that you submit to us which is associated with your account can be removed at any time by selecting the applicable settings on the Site. Note, however, that some personal information is necessary to use our Site. As such, even if you remove all of your personal information from your account, we may retain some of your personal information to comply with our legal obligations or as necessary to provide the Site to you.

Site Usage Data

When users visit our Site, we automatically track and collect information about those visits in our server logs from the user’s browser or device. This information is known as "Site Usage Data". Information that we automatically collect may include personal information such as the user’s IP address, geolocation data, and browser type, as well as the referring or exit pages, the page(s) requested, and cookie information. Based on the user’s IP address, we may be able to obtain further personal information about the user, such as the identity of their internet service provider and the geographic location of their point of connectivity.

Other types of information that we collect as Site Usage Data includes data such as the pages of our Site that were visited, the order in which those pages were visited, when they were visited, and which hyperlinks were "clicked" on our Site. We do not treat Site Usage Data as personal information if it does not identify you and is not linked to your personal information.

Do-Not-Track Signals

Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. As of the date on which this Privacy Policy was last updated, however, there is no standardized DNT signal. As such, our Site does not currently respond to browser DNT signals. If you do not wish to be tracked, you may also be able to opt out by selecting certain options in the settings browser or device that you use to access the Site, or by using certain third-party applications and programs.

Our Uses of Personal Information

In general, we use your personal information to process your requests, to facilitate your use and our administration and operation of the Site, to provide you with information or services you request, to learn more about and improve the Site, and for the purpose for which information was provided. Some of the ways in which we may use the information that we collect include:

  • sending you account-related e-mails;
  • responding to your e-mails, submissions, comments, requests for technical support or assistance, or complaints;
  • to show you ads that may be of interest to you;
  • providing the Site to you;
  • developing, customizing, and improving the Site, and the resources that Accelbyte provides (including without limitation administering our Site; managing our communications; analyzing and enhancing the Site; protecting the security of our networks and information systems; and performing accounting, auditing, invoicing, and other internal administrative activities);
  • identifying and protecting against fraud, prohibited or illegal activities, as well as potential third-party claims and other liabilities; and
  • generally complying with applicable laws, rules, and regulations.

From time to time, we may use your personal information to contact you about other services we offer that may interest you. We may also send non-marketing and administrative communications to you from time to time (such as account issues).

We may also use information about you to create and use anonymous, statistical or aggregated data. Such aggregated data does not allow any party to identify you or any other specific user, and is not personal information subject to this Privacy Policy. We use such aggregated data to maintain and operate the Site, to improve the quality of the Site, to create new services and features, and for further internal, commercial and statistical purposes. Information that we collect about you will be retained for the periods authorized by applicable law.

Behavioral targeting/Re-targeting

We have partnered with Google Analytics, and may partner with other third parties, to either display advertising on our Site or to manage our advertising on other sites. Our third-party partners may use technologies such as cookies or similar technologies to gather information about your activities on this Site and other sites in order to create advertising for us based on your browsing activities and interests.

If you wish to opt out of the Google Analytics features that we use while using the Site on your web browser, you may do so by using Google Analytics’s opt-out functions, which are available here (https://tools.google.com/dlpage/gaoptout). You may also be able to opt out of Google Analytics by selecting certain options in your Ads Settings or by using certain third-party applications and programs for indicating consumer consent.

Sharing of Personal Information

Except as set forth herein, Accelbyte does not sell, rent or lease your personal information to third parties. We may, however, share some of your personal information with third parties such as our business partners and service providers (e.g., internet and cloud hosting services providers, such as Amazon Web Services), and merchants in the course of using their products or services to provide the Site, or for other purposes related to the Site. We may also share personal information with third parties when you request that we do so or otherwise give your consent—for example, if you sign up for an account on our Site as part of your game studio’s subscription to our services, we may share your personal information with your employer as necessary to enable your account to access the features being provided to your employer.

We may also disclose your personal information if required to do so by law or if we otherwise believe it appropriate and/or necessary: (a) to comply with any decrees, laws and/or statutes or in an effort to comply with any legal process served upon us or upon the Site; (b) to maintain, safeguard and/or preserve our rights or property; (c) act under exigent circumstances to protect the personal safety of our users and/or the public; (d) to complete our obligations in the event that Accelbyte is acquired through a sale, merger, or otherwise experiences a change in corporate control; and/or (e) to enforce our rights and agreements. We reserve the right to disclose or transfer any information we have about you as part of, or during negotiations of, any merger, sale of company assets, or acquisition, or in any other situation where personal information may be transferred with other assets of Accelbyte.

If we determine that it is necessary and advisable to disclose your personal information, we may do so without notice to you.

Protecting Personal Information

Accelbyte uses commercially reasonable security measures to protect the information that we collect about you. Nevertheless, you are responsible for securing the account that you use to access our Site. Your obligations include monitoring your account activities, choosing a secure password, and maintaining the confidentiality of your password. We cannot guarantee the security of any personal information that you send to our Site, nor can we guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. If you elect to provide any personal information to us, you should be aware that you provide that information at your own risk. Accelbyte cannot be held responsible for your failure to keep your account information secure.

Your Responsibilities; Opting out of Communications

You are responsible for verifying the accuracy of the personal information you submit to the Site and ensuring that any personal information that you provide is kept up to date for the purposes for which you provide it. Inaccurate information may affect your ability to use the Site, the information you receive when using the Site, and our ability to contact you.

We only send e-mails to persons who have provided their e-mail addresses directly to us and who have consented to receive communications from us. If you are a user of our Site, you can choose whether to receive promotional communications from us by logging into your account and accessing and changing your communication preferences. You may also opt out of receiving marketing e-mail communications at any time by contacting us, or by clicking on the "Unsubscribe" link at the bottom of the e-mail and following the instructions provided.

Please note that even if you opt out of receiving promotional e-mails from us, you may still receive relationship e-mails from us, including responses to e-mails that you sent to us prior to opting out, notices of updates or changes to our policies and procedures, or other messages relating to your account and/or your use of the Site.

Additionally, because our system for processing opt-out requests is not automatic, your request may not be processed immediately. You may continue to receive some communications from us during the processing period.

SPECIAL NOTICES

Regarding Use of the Site by Children

Accelbyte does not knowingly collect any information from anyone under 13 years of age. If you are less than 13 years of age, we request that you do not submit information to us. If we become aware that we have inadvertently collected "personal information" (as defined by the United States Children’s Online Privacy Protection Act) from children under the age of 13 without parental consent, we will take reasonable steps to delete it as soon as possible as required by applicable law.

Regarding Links to Other Websites

From time to time, we may provide links to third-party websites on the Site. Any such links from the Site to third-party resources are provided for your convenience. Personal information that you provide to third-party platforms is not subject to this Privacy Policy.

Rights under Data Privacy Law

At this time, Accelbyte is not subject to the General Data Protection Regulation of the European Union or the United Kingdom, nor to the state-level data privacy laws of California, Connecticut, Colorado, Iowa, Virginia, or Utah.
